1About this agreement#
This End User License Agreement (“EULA”) is a legal agreement between you and VAILENTIN SRL, the company that operates deesput. It governs your use of the deesput mobile app, including its updates (the “App”).
You accept this EULA when you tick the box on the welcome screen and create an account or sign in. If you do not agree with it, do not download, install or use the App.
This EULA works together with our Terms of Service (the “Terms”), our Community Guidelines and our Privacy Policy. The Terms explain how the deesput service works. This EULA covers your license to use the App itself and the terms that Apple requires. If this EULA and the Terms conflict on those two matters, this EULA applies.
This EULA is concluded between you and us only, and not with Apple Inc. We, not Apple, are solely responsible for the App and its content.
This EULA is not meant to set usage rules for the App that conflict with the Apple Media Services Terms and Conditions. If there is a conflict, Apple’s Usage Rules apply to the extent of that conflict.
2Who we are#
In this EULA, “deesput”, “we”, “us” and “our” mean VAILENTIN SRL, a company registered in Romania with EUID ROONRC.J2020002950239. “You” means the person using the App.
For questions and help with the App, write to support@deesput.com. Please send complaints or claims about the App to legal@deesput.com. Our contact details are also at the end of this page.
3Your license to use the App#
The App is licensed to you, not sold. As long as you follow this EULA, we give you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download, install and use the App on devices that you own or control, in order to use deesput as described in the Terms.
- If you downloaded the App from the Apple App Store, you may use it on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- You may use the App for your personal use and, through business identities, ads and boosts, for your business or organization, as the Terms allow.
- Each person needs their own deesput account. Family Sharing gives other people access to the App, not to your account.
We and our licensors keep all rights that this EULA does not expressly give you, including all intellectual property rights in the App.
4What you may not do#
Unless the law expressly allows it, you must not:
- copy, modify, adapt or translate the App, or create works based on it;
- decompile, disassemble or reverse-engineer the App, or try to extract its source code, except where the law allows it despite this restriction;
- rent, lease, lend, sell, redistribute or sublicense the App, or make it available over a network where several devices could use it at the same time;
- remove, hide or change any copyright, trademark or other notice in the App;
- get around, disable or interfere with the App’s security features, its limits, or features that protect content from being copied;
- access the Service through bots, scrapers, crawlers or unofficial apps;
- use the App to develop a competing product or service;
- use the App in a way that breaks the law, this EULA, the Terms or the Community Guidelines.
5Updates and availability#
We may release updates to fix errors, improve security or add, change or remove features. Some updates may be needed to keep using the App. Updates are covered by this EULA unless they come with their own terms.
We may change the App or stop offering it, or parts of it, as described in the Terms. Where the law gives you a right to updates, for example to keep the App secure and working as described, we will provide them.
6No tolerance for objectionable content and abusive users#
There is no tolerance on deesput for objectionable content or abusive users. By accepting this EULA, you agree not to post objectionable content and not to abuse other people anywhere in the App, including in posts, MicroVideos, comments, chats, names, topics, events and ads.
6.1Objectionable content
Objectionable content is anything that breaks the law or our Community Guidelines, and in particular:
- pornography and sexually explicit content, and nudity outside clearly non-sexual contexts;
- any content that sexualizes, exploits or endangers children;
- hate speech, and content that attacks people for who they are;
- harassment, bullying, threats and intimidation;
- violent, graphic or shocking content, and content that supports terrorism or violent extremism;
- content that promotes or gives instructions for suicide, self-harm or eating disorders;
- illegal activity, and the sale of illegal or regulated goods;
- spam, scams, fraud and fake engagement, including links to phishing, malware or other harmful websites;
- impersonation, and sharing other people’s private information without their consent.
6.2Abusive users
Abusive behavior includes harassing, threatening or bullying people, contacting someone again and again after they asked you to stop or blocked you, using another account or business identity to get around a block, a suspension or a termination, and making false reports on purpose.
6.3Tools that protect you
- Report. You can report posts, MicroVideos, profiles and business identities from the … menu. We do not tell the person you reported who reported them.
- Block. You can block any person or business identity from the … menu or from their profile. They can no longer message you, invite you or interact with you, and you no longer see their content in your feeds.
- Filter. You choose the topics you want to see and the topics you want to exclude, and your feeds follow those choices.
- Links. Before a link opens, the App shows you the address of the website it leads to. You can open it, ignore it, report it, or turn links off in Settings → Content Setup → Web Links. Links open in your device’s own browser, outside the App.
- Notify us. Anyone, including people without an account, can report illegal content to legal@deesput.com.
6.4What we do
We review reports, and we aim to act on reports of objectionable content within 24 hours. Automated filters also refuse offensive and reserved words in names and usernames, and keep links and web addresses out of titles and topic names.
In this EULA, these words mean:
- Title means the short name you give your content when you create it. It is the Title field of a post or a MicroVideo, the Event Title field of an event, and the Campaign Name field of an ad.
- Description means the longer text you write under the title of a post or a MicroVideo, to say what it is about.
- Caption means the text of an ad, written in its Caption field. For an ad, the caption does the job that the description does for a post or a MicroVideo.
- Comments and chat messages are neither titles nor descriptions.
When content breaks these rules, we remove it and take action against the account that posted it. Serious violations lead to the immediate and permanent removal of the user from deesput, without a prior warning. These include child sexual exploitation, credible threats of violence, terrorism or violent extremism, human trafficking, sharing intimate images without consent, and fraud. Other violations lead to the actions described in the Community Guidelines, and repeated violations lead to termination. We may preserve evidence and report it to law enforcement and other competent authorities.
If you disagree with a decision we made about you, you can ask us to review it, as described in the Terms.
7Your content and content made with AI#
You own the content you create in the App, and you give us the license described in the Terms so that we can show it. You are responsible for what you post, and you must have all the rights needed to post it.
If any part of a post, a MicroVideo or an ad was generated by artificial intelligence, or edited with AI in a way that changes what it shows or says, you must mark it Made with AI when you create it. You are solely responsible for marking your content correctly, as described in the Terms.
8Purchases and subscriptions#
The App is free to download. The Essential, Plus and Premium subscriptions and the in-app purchases (topic slots, business identity slots, ads and boosts) are sold and billed by Apple through your Apple account.
- Subscriptions renew automatically until you cancel them in your Apple account settings, at least 24 hours before the end of the current period.
- Refunds are handled by Apple, at reportaproblem.apple.com.
- Deleting the App or your account does not cancel a subscription.
The full rules are in the Subscriptions and In-app purchases and refunds sections of the Terms.
9Privacy and device permissions#
How we collect, use and protect your personal data is explained in our Privacy Policy.
The App asks for your permission before it uses features of your device, such as your photos, camera, microphone or notifications. You can change these permissions at any time in your device settings. Some features may not work without them. The App does not use your device’s GPS location.
10Support and maintenance#
We are solely responsible for providing any maintenance and support for the App, as described in this EULA or as required by law. Apple has no obligation whatsoever to provide any maintenance or support for the App.
For help with the App, contact us at support@deesput.com, or see our Support page.
11Warranty#
We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed.
If you are a consumer, the mandatory law of your country gives you a legal guarantee that the App matches its description and works as it should. In the European Union, this comes from the rules on the supply of digital content and digital services. Nothing in this EULA limits that guarantee.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App, if any, to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to any warranty are our sole responsibility.
Apart from that, and to the extent the law allows, the App is provided “as is” and “as available”, as described in the Terms.
12Claims relating to the App#
We, not Apple, are responsible for addressing any claims by you or by a third party relating to the App or to your possession and use of it, including:
- product liability claims;
- any claim that the App fails to conform to any applicable legal or regulatory requirement;
- claims arising under consumer protection, privacy or similar legislation.
This EULA does not limit our liability to you beyond what the applicable law permits.
13Intellectual property claims#
If a third party claims that the App, or your possession and use of it, infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
This covers the App itself. You remain responsible for the content you post, as described in the Terms.
14Export controls and sanctions#
You represent and warrant that:
- you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country;
- you are not listed on any U.S. Government list of prohibited or restricted parties;
- you are not the target of sanctions adopted by the European Union or the United Nations.
You must not use the App in breach of any export control or sanctions law.
15Other companies’ terms#
When you use the App, you must also comply with the terms of other companies that apply to you, for example:
- the agreement with your mobile or internet provider. The App uses data, especially for videos, and your provider may charge you for it;
- the Apple Media Services Terms and Conditions and the terms of your Apple Account, including Sign in with Apple;
- the terms of the websites and services whose content you share or open through the App. Links open in your device’s own browser, outside the App. We do not control those websites and are not responsible for them.
16Apple as a third-party beneficiary#
You and we acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA, and that, once you accept this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
17Ending this license#
This license lasts until you or we end it.
- You can end it at any time by deleting your account, in Settings → Account → Delete Account, and deleting the App from your devices. Remember to cancel any Apple subscription first.
- We may end it, or suspend your access to the App, if you break this EULA, the Terms or the Community Guidelines, or for the other reasons and in the way described in the Terms.
When this license ends, you must stop using the App and delete it from your devices. The sections of this EULA that by their nature should continue, such as those on warranty, claims, liability and disputes, continue to apply.
18Limitation of liability#
Our liability to you is described in the Limitation of liability section of the Terms. Nothing in this EULA excludes or limits any liability that cannot be excluded or limited by law, and this EULA does not limit our liability to you beyond what the applicable law permits.
19Governing law and disputes#
This EULA is governed by the law of Romania. Disputes are handled as described in the Governing law and disputes section of the Terms. If you are a consumer living in the European Union, you also keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of the country where you live.
20Changes to this EULA#
We may update this EULA when the App, our business or the law changes. The date at the top of this page shows when it was last updated.
If we make important changes, we will tell you in the App or by email at least 30 days before they take effect, unless a change is required by law or needed urgently to protect the App or its users. If you do not agree with the updated EULA, you can stop using the App and delete your account before it takes effect. If you keep using the App after that, the updated EULA applies.
21General#
- Severability. If any part of this EULA is found invalid or unenforceable, the rest remains in force.
- No waiver. If we do not enforce a right immediately, we may still enforce it later.
- Transfer. You may not transfer this license. We may transfer this EULA to another company as part of a merger, acquisition, restructuring or sale of the business, as long as your rights are not reduced.
- Language. This EULA is written in English. If we provide a translation, the English version prevails, except where the law of your country requires otherwise.
