1Acceptance of these Terms#

These Terms of Service (“Terms”) are a legal agreement between you and VAILENTIN SRL, the company that operates deesput. They apply to the deesput mobile app and to the pages we publish on deesput.com (together, the “Service”).

You accept these Terms when you tick the box on the welcome screen and create an account or sign in. If you do not agree with them, do not use the Service.

The following documents are part of these Terms, and by accepting these Terms you accept them too:

If there is a conflict between these Terms and one of those documents, these Terms apply, with two exceptions: the Privacy Policy applies to matters of personal data, and the End User License Agreement applies to your license to use the app and to the terms that Apple requires.

2Who we are#

In these Terms, “deesput”, “we”, “us” and “our” mean VAILENTIN SRL, a company registered in Romania with EUID ROONRC.J2020002950239. “You” means the person using the Service.

deesput® is a registered trademark of Valentin Cobelea. You can contact us at legal@deesput.com. This address is also our single point of contact for users and for public authorities under the EU Digital Services Act. You can write to us in English or Romanian.

3Who can use deesput#

You may use deesput only if:

If we learn that an account belongs to someone under 16, we will delete it.

If you use deesput on behalf of a business or organization, for example through a business identity or by running ads, you confirm that you are authorized to act for it, and it is bound by these Terms as well.

4Your account#

4.1Creating your account

You can create an account with your email address or with Sign in with Apple. You must give accurate information and keep it up to date. You choose a username when you sign up. Your username is permanent and cannot be changed, so choose it carefully. Your display name, profile picture and other details can be changed at any time.

4.2Keeping it secure

You are responsible for keeping your password safe and for everything that happens through your account. Do not share your account or let anyone else use it. If you believe someone has accessed your account without permission, change your password and tell us at support@deesput.com.

4.3Names and usernames

Names and usernames must follow our Community Guidelines. They may not impersonate anyone, mislead people about who you are, contain offensive language, or be used to promote a website. The name deesput and names that look like it are reserved. We may refuse, change or reclaim a name or username that breaks these rules or someone else’s rights.

5The deesput Service#

deesput is a topic-first social platform. You choose the topics you want to see and the topics you want to exclude, and your feeds are built from those choices. The Service includes, among other things:

5.1How your feeds are ordered

Your feeds show content filtered by the topics you choose to see and to exclude. Content is not ranked by predicted engagement, and there is no algorithm designed to keep you scrolling. Sponsored posts (for users on the Free plan) and boosted posts appear at fixed positions in the feeds and are always marked.

5.2Changes and availability

We are constantly improving deesput, so we may add, change or remove features. We will try to keep the Service available at all times, but it may sometimes be interrupted, for example for maintenance, updates, security reasons or events outside our control. We do not guarantee that the Service will always be available or free of errors.

5.3Limits

To protect the Service, we limit how often some actions can be repeated (for example posting, messaging, sending friend requests or uploading files), and how large files can be. Limits may differ between plans. If you reach a limit, the app tells you when you can try again.

6Your content#

6.1You own your content

You keep ownership of the posts, MicroVideos, comments, messages, images, videos and other content you create on deesput (“your content”). You are responsible for it, and you confirm that you have all the rights needed to post it.

6.2The permission you give us

So that we can run the Service, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt (for example resize, compress or convert), display and distribute your content, and to let our service providers do the same on our behalf. We use this license only to operate, protect and improve the Service, and to show your content to the people you share it with, according to your settings.

This license ends when your content is deleted from our servers, except that:

6.3Public content and share links

Much of what you post is visible to other users. When content is shared with a link, deesput.com shows a public preview of it that anyone with the link can see. Think carefully before you post anything you do not want others to see or keep.

6.4Deleting your content

You can delete your posts and MicroVideos at any time. They disappear from the app immediately. We keep a hidden copy for 30 days, or for 12 months if the content has been reported, and longer while a legal case or a request from an authority about it is open. After that it is permanently deleted, as described in our Privacy Policy.

6.5Links you share

In these Terms, these words mean:

You can add links to websites in chats, in comments, in the descriptions of posts and MicroVideos, in the captions of ads and as the website of a business identity. Links and web addresses are not allowed in titles or in topic names, including addresses that are disguised, for example by spelling out or replacing the dot. Links in events cannot be opened.

You are responsible for the links you share. They must not lead to content that is illegal, or that would break these Terms or the Community Guidelines if it were posted on deesput, including scams, phishing, malware and other harmful websites. We may remove a link, or the content that contains it, and take action under these Terms.

7Content made with AI#

When you create a post, a MicroVideo or an ad, you can mark it as Made with AI, and it will show a robot icon.

You are solely responsible for marking your content correctly. You must mark it whenever any part of it was generated by artificial intelligence, or was edited with AI in a way that changes what it shows or says, and in particular whenever it realistically shows real people, places or events in a way that did not happen. This also helps you meet your own obligations under the law, including the EU Artificial Intelligence Act.

Marking content does not make otherwise prohibited content allowed. If content that should be marked is not, we may add the mark, remove the content or take other action under these Terms.

8Rules of conduct#

You must follow the law and our Community Guidelines. In addition, you must not:

9Private messages and chat files#

Chats are private between the people in them. Your messages are stored on our servers in encrypted form. Our encryption is not end-to-end, which means we can access messages when the law requires it, to investigate a serious report or a threat to someone’s safety, or to protect our rights, as explained in our Privacy Policy.

Files sent in chat are temporary. Images, videos and documents are kept on our servers for 6 hours on the Free plan, 12 hours on Essential, 18 hours on Plus and 24 hours on Premium, based on the plan of the person who sent them, and are then permanently deleted. A copy the recipient has already opened may remain on their device for up to 7 days. Do not use chat as a place to store files you need to keep.

The Community Guidelines apply in chats as everywhere else. If someone reports a conversation, we may review the messages and files involved in that report.

10Topics#

Anyone can add general topics to their posts. Users on the Plus and Premium plans can also own topics.

10.1Owning a topic

10.2When a topic slot ends

If a topic’s slot ends and is not renewed, the topic becomes dormant: after a short grace period it can no longer be used, but we keep it so that you can renew it. A topic that stays dormant for 12 months is archived permanently, and its name may become available to others.

Topics included with your plan depend on that plan. If you change to a plan that does not include them, they become dormant or frozen until you upgrade again. Frozen topics stay visible but cannot be used.

10.3Our rights

We may rename, remove, freeze or reassign a topic that breaks these Terms or the Community Guidelines, that infringes someone else’s rights, or that misleads people, including when a rights holder complains. In that case we do not refund the slot.

11Business identities#

A business identity works like a business page on other social platforms: a separate profile with its own posts, followers and topics, under the same login, account and subscription as your personal profile.

If you use deesput as a business user within the meaning of EU Regulation 2019/1150 (platform-to-business relations), we will give you the notice and the reasons that Regulation requires before restricting or terminating your use of the Service, except where it allows us to act immediately.

12Subscriptions#

deesput is free to use. Paid plans, Essential, Plus and Premium, add features. What each plan includes is described in the Marketplace in the app at the time you subscribe.

12.1Billing and renewal

12.2Changing plans

Moving to a higher plan takes effect immediately. Moving to a lower plan, or between monthly and yearly billing of the same plan, takes effect at your next renewal date. These rules follow Apple’s subscription rules.

12.3Price and feature changes

We may change our prices or what a plan includes. If a change increases the price of your subscription, Apple will ask for your consent before it applies. If a change significantly reduces what your active subscription includes, we will tell you in advance, and you can cancel before it takes effect.

12.4Deleting your account does not cancel your subscription

Only you can cancel an Apple subscription, in your Apple account settings. Please cancel it before you delete your deesput account, otherwise Apple may keep charging you.

12.5Restoring purchases

If you reinstall the app or change device, use Restore Purchase at the bottom of the Marketplace.

13In-app purchases and refunds#

You can also buy topic slots, business identity slots, ads and boosts. These are one-time purchases, sold and billed by Apple.

13.1Refunds

Because Apple processes all payments, refunds are handled by Apple under its own terms. You can request one at reportaproblem.apple.com. We do not issue refunds ourselves, including when content, topics, business identities, ads or boosts are removed or restricted because they broke these Terms.

Nothing in these Terms affects the rights you have under Apple’s terms or under the mandatory consumer law of your country.

14Ads and boosts#

15XP, levels, badges and rewards#

You earn experience points (XP), levels and badges by using deesput. Some levels unlock rewards, such as a topic slot for a limited period. Rewards can only be used on plans that allow them.

XP, levels, badges and rewards have no monetary value, are not your property, and cannot be sold, exchanged or transferred. We may correct them if they were obtained through an error or by breaking these Terms, and we may change how they work.

16Our intellectual property#

The Service, including the app, its design, software, text, graphics, skins, badges and other materials we provide, belongs to us or to our licensors, and is protected by copyright, trademark and other laws. deesput® is a registered trademark of Valentin Cobelea. Except for the limited license in our End User License Agreement, these Terms do not give you any rights in our intellectual property, and you may not use our names, logos or trademarks without our written permission.

If you send us ideas or feedback, we may use them freely, without any obligation to you.

17Reporting illegal content and rights complaints#

You can report content and accounts in the app from the … menu, and a suspicious link from the window that appears when you tap it. Anyone, including people without an account, can also notify us of content they believe is illegal, or that infringes their copyright, trademark or other rights, by writing to legal@deesput.com. Please include:

We will confirm receipt, review the notice and tell you what we decided. Accounts that repeatedly infringe other people’s rights will be terminated. Sending notices that you know to be false is a breach of these Terms.

18Moderation and enforcement#

We are not required to monitor everything posted on deesput, but we may review content and accounts at any time, and we act on reports. Moderation decisions are made by people. Some protections are automated: rate limits, upload and size limits, filters that refuse offensive or reserved names, checks that protect brands in business identity and topic names, and checks that keep links and web addresses out of titles and topic names.

If content or behavior breaks the law, these Terms or the Community Guidelines, we may take the action we consider proportionate to the seriousness of the violation, whether it was repeated, and the risk of harm, including:

Serious violations lead to immediate and permanent termination, without a prior warning. These include child sexual exploitation, credible threats of violence, terrorism or violent extremism, human trafficking, sharing intimate images without consent, and fraud.

18.1Reasons and review

When we remove your content or restrict or terminate your account, we will tell you which rule was broken and what we decided, unless the law prevents us or doing so would put someone at risk. If you disagree, you can ask us to review the decision by writing to legal@deesput.com within six months. A person will review your request. You also keep any other remedy the law gives you, including going to court.

19Deleting your account and termination#

19.1By you

You can stop using deesput and delete your account at any time in the app, in Settings → Account → Delete Account. Deletion is immediate and permanent, as described in our Privacy Policy. Remember to cancel any Apple subscription first.

19.2By us

We may suspend or terminate your account, or your access to part of the Service, if you break these Terms or the Community Guidelines, if the law requires it, if your use creates a risk or legal exposure for us, our users or others, or if we stop providing the Service. Where appropriate we will give you notice in advance, and we will give you the reasons, as described under Moderation and enforcement.

19.3What happens then

When your account ends, your right to use the Service ends, and your content is deleted as described in our Privacy Policy. Paid features, topics, business identities, ads, boosts, XP and rewards linked to the account are lost, without a refund from us. The sections of these Terms that by their nature should continue, such as those on content licenses already used, intellectual property, liability, and disputes, continue to apply.

20Other companies’ services#

deesput works with services provided by other companies, such as Apple (for sign-in, payments and notifications), and shows previews of content from other websites, such as YouTube and other social platforms, when users share links. Their own terms and privacy policies apply to how you use them. We are not responsible for other companies’ services, websites or content, and a link or preview does not mean we endorse it.

Links open outside deesput. When you tap a link, the app first shows you the address of the website it leads to and asks you to confirm. If you open it, it opens in your device’s own web browser. We do not control, check or endorse other websites, and you open them at your own risk. Their own terms and privacy policies apply. You can turn links off at any time in Settings → Content Setup → Web Links, and you can report a suspicious link from the same window.

Events are created by users. We do not organize, check or supervise events, and you attend them at your own risk. Weather forecasts come from a third-party provider and are for information only.

21Disclaimers#

We work hard to make deesput useful, safe and reliable. But, to the extent the law allows, the Service is provided “as is” and “as available”, without any promise that it will meet your needs, be uninterrupted, secure or error-free, or that content on it is accurate, complete or reliable.

Content on deesput is created by users, not by us. It reflects their views, not ours, and we are not responsible for it. Do not rely on content from other users for medical, legal, financial or other professional advice.

Nothing in this section limits the rights you have as a consumer under the mandatory law of your country, including your legal rights if the Service is not as described or does not conform to these Terms.

22Limitation of liability#

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for damage we cause intentionally or through gross negligence, or for anything else that cannot be excluded or limited by law.

Subject to that, and to the extent the law allows:

23Your responsibility for claims#

If you use deesput for business purposes, for example through a business identity or by running ads, you will defend and compensate VAILENTIN SRL, its directors and staff against any claim, loss, damage and reasonable cost, including legal fees, arising from your content, your ads, your use of the Service, or your breach of these Terms or of the law.

If you use deesput as a consumer, you are responsible for the damage you cause through a breach of these Terms, as provided by law.

24Changes to these Terms#

We may update these Terms when the Service, our business or the law changes. The date at the top of this page shows when they were last updated.

If we make important changes, we will tell you in the app or by email at least 30 days before they take effect, unless a change is required by law or needed urgently to protect the Service or its users, in which case it may apply sooner. If you do not agree with the updated Terms, you can stop using deesput and delete your account before they take effect. If you keep using deesput after they take effect, the updated Terms apply.

25Governing law and disputes#

These Terms are governed by the law of Romania. If you are a consumer living in the European Union, you also keep the protection of the mandatory provisions of the law of your country of residence.

If you have a problem with deesput, please contact us first at legal@deesput.com. We will try to resolve it quickly and fairly.

Any dispute that cannot be resolved this way will be settled by the competent courts of Bucharest, Romania. If you are a consumer, you may also bring proceedings in the courts of the country where you live. Consumers can also contact a consumer protection authority. In Romania this is the National Authority for Consumer Protection (ANPC), anpc.ro.
